Speeding Offenses

Driving over the posted speed limit is a violation of traffic laws.

Penalties vary based on your driver’s license class and how much you exceeded the speed limit. The consequences include:

  • 0 to 6 demerit points depending on the speed
  • G1 and G2 drivers may face a 30-day license suspension for tickets with 4 demerit points
  • Fines based on the extent of the speeding violation
  • Potential increase in insurance premiums
  • Additional demerit points for speeding more than 15 km/h over the limit

Stunt Driving

 It is prohibited for any individual to operate a motor vehicle on a highway while racing, engaging in a stunt, or driving as part of a bet or wager.

Penalties:

A stunt driving offense is issued when a driver exceeds the speed limit by more than 50 km/h. Upon receiving a stunt driving charge, the driver’s license is immediately suspended for 7 days, and their vehicle is impounded for the same duration. Other actions that may result in a stunt driving charge include transporting a person in the trunk, losing control while spinning, aggressive driving, and road rage.

Failure to Stop for Police

A driver commits an offense when they do not stop their vehicle upon being signaled or directed by a police officer.

Penalties:

Failing to stop for law enforcement can result in severe consequences, including:

  • Seven demerit points on the driving record
  • A fine ranging from $1,000 to $10,000
  • Up to six months in jail
  • Potential increase in insurance premiums
  • Possible driver’s license suspension

Prohibited Turn Violation

A driver may be charged with a prohibited turn violation if they disregard a traffic sign and make an illegal turn.

Consequences:

Making a turn against posted restrictions can lead to more than just a simple fine. Additional penalties include:

  • Two demerit points added to the driving record
  • A $110 fine
  • A conviction recorded on the driving history for three years
  • Possible increase in insurance premiums

Distracted Driving Due to Cell Phone Use

Driving while using a hand-held wireless device, such as a cell phone, capable of transmitting or receiving calls, texts, emails, or other electronic data, is prohibited under Ontario’s Highway Traffic Act, section 78.1.1.

This law states that a driver cannot hold or use a functioning communication device while on the road, whether the vehicle is moving or stationary. Penalties for distracted driving vary depending on the type of driver’s license.

For G license holders, the penalties for distracted driving increase with each conviction:

First Conviction:

  • Three demerit points
  • A fine of $615 if paid out of court (includes victim surcharge and court fee)
  • Up to $1,000 fine if the ticket is contested in court and lost
  • A three-day license suspension

Second Conviction:

  • Six demerit points
  • A fine of $615 if paid out of court (includes victim surcharge and court fee)
  • Up to $2,000 fine if the ticket is contested in court and lost
  • A seven-day license suspension

Third and Subsequent Convictions:

  • Six demerit points
  • A fine of $615 if paid out of court (includes victim surcharge and court fee)
  • Up to $3,000 fine if the ticket is contested in court and lost
  • A thirty-day license suspension

Driving Without Insurance

A driver may face charges if they operate a vehicle without valid insurance or allow someone else to drive their uninsured vehicle.

Penalties for Driving Without Insurance:

Driving without proper coverage carries serious consequences, including:

  • First offense: Fines ranging from $5,000 to $25,000
  • Second offense: Fines between $10,000 and $50,000
  • Possible driver’s license suspension for up to one year
  • Vehicle impoundment for up to three months
  • An additional 25% victim fine surcharge under the Provincial Offences Act

Ensuring your vehicle has valid insurance is essential to avoid these severe penalties.

Driving While Suspended

Operating a motor vehicle while your driver’s license is suspended under any legislative act or regulation is a serious offense and can lead to significant penalties.

Consequences Upon Conviction:

  • First offense: A fine ranging from $1,000 to $5,000
  • Subsequent offenses: A fine between $2,000 and $5,000
  • Up to six months in jail or both a fine and imprisonment

Additional Penalties:

  • Possible jail time of up to six months
  • A mandatory minimum fine of $1,000
  • A six-month extension of the license suspension
  • A minimum fine of $5,000 for cases related to alcohol-related suspensions
  • Potential insurance repercussions, including policy cancellation or premium increases

Repeated violations result in significantly harsher penalties.

Failure to Remain at the Scene

If you are involved in or witness a collision, the law requires you to stay at the scene and provide necessary assistance.

Legal Obligations:

Anyone involved in an accident must:

  • Stay at or return immediately to the accident site
  • Offer assistance to those in need
  • Provide, upon request, the following information to an injured party, a police officer, or a witness:
    • Full name and address
    • Driver’s license number and issuing jurisdiction
    • Vehicle insurance provider and policy number
    • Registered owner’s name and address
    • Vehicle permit number

Penalties for Failure to Remain:

Violating this law is a serious offense under the Highway Traffic Act and may result in:

  • Seven demerit points on your driving record
  • A fine ranging from $400 to $2,000
  • A jail sentence of up to six months
  • Possible license suspension for up to two years
  • Increased insurance premiums
 

Careless Driving

A motorist may face a careless driving charge if they operate a vehicle without proper caution, attention, or consideration for others on the road. This offense applies to drivers who fail to ensure the safety of themselves and those around them.

Penalties:

The consequences for careless driving vary based on the driver’s license class, but the following apply to all:

  • Six demerit points, remaining on record for two years
  • A $490 fine
  • Higher insurance premiums for up to three years

In more serious cases, a conviction may result in:

  • A fine ranging from $400 to $2,000
  • Up to six months in jail
  • Careless driving causing bodily harm can lead to fines of up to $50,000

Stop Sign Violation

A driver commits a stop sign violation when they fail to bring their vehicle to a complete stop at or before the designated stop line.

Penalties:

Drivers who do not fully stop at a stop sign may face the following consequences:

  • Three demerit points added to their driving record
  • A $110 fine
  • Potential increase in insurance premiums
  • A conviction recorded on their driving history for three years
